2. About These Terms
These Terms & Conditions set out the basis on which we sell baked goods and related products through our website.
They apply to all consumer orders placed through www.terrybakes.com. Nothing in these terms affects your statutory rights.
3. Our Products
We sell baked goods including, but not limited to, brownies, blondies, cookies, cakes and mystery boxes.
As many of our products are handmade, there may occasionally be slight differences in appearance, decoration, topping, colour, slicing or presentation.
Where products are sold as mystery boxes, the contents are chosen by us and may vary from box to box depending on availability, seasonality and current baking schedules.
All products are subject to availability.
4. Allergens and Dietary Information
Our products are made in a kitchen environment that may handle common allergens, including but not limited to:
- milk
- eggs
- wheat
- gluten
- soya
- nuts
- peanuts
If you have any allergy, intolerance or dietary concern, you should contact us before placing an order.
It is your responsibility to check product information and contact us before ordering if you are unsure whether a product is suitable for you or the recipient.
5. Placing an Order
When you place an order through our website, you are making an offer to buy goods from us.
Your order is only accepted when we dispatch it. Any order confirmation or acknowledgement email sent after checkout does not mean the order has been accepted.
We reserve the right to refuse or cancel an order before dispatch where necessary, including where:
- a product is unavailable
- there is an obvious pricing error
- we believe there has been misuse of the website
- we are unable to fulfil the order for operational or safety reasons
If we cancel an order before dispatch, we will refund any payment taken for that order.
6. Prices and Payment
All prices shown on our website are in Pounds Sterling (£).
Prices shown on the website are the prices payable at the time of ordering, subject to any obvious pricing errors.
Delivery charges, where applicable, will be shown at checkout before you complete your purchase.
Payment must be made in full at the time of ordering using one of the payment methods made available on the website.
7. Customer Accounts
If you create an account on our website, you are responsible for keeping your login details confidential and for taking reasonable steps to prevent unauthorised access to your account.
You must ensure that the information you provide to us is accurate and up to date.
We may suspend or close accounts where we reasonably believe there has been misuse of the website or breach of these terms.
8. Delivery
We deliver to the mainland United Kingdom.
Any delivery timescales shown on the website are estimates unless we specifically agree a fixed delivery date with you.
We will aim to dispatch and deliver orders within the timeframe stated on the website or at checkout, but delays can occasionally occur due to courier issues, weather, high demand or other events outside our reasonable control.
Responsibility for the goods remains with us until they are delivered to you or to a person identified by you to take possession of them.
It is your responsibility to ensure that the delivery address is correct and that someone is available to receive the order where necessary.
9. Perishable Goods and Storage
Our baked goods are perishable food products.
Once delivered, products should be stored and consumed in accordance with any storage guidance provided on the packaging, product page or accompanying information.
We are not responsible for deterioration in quality caused by incorrect storage, delay in opening the parcel after delivery, or failure to follow any storage or serving instructions provided.
10. Cancellations
Because our products are perishable and liable to deteriorate quickly, orders may be cancelled for a full refund only before dispatch.
Once an order has been dispatched, it cannot be cancelled simply because you have changed your mind.
This does not affect your rights where goods are faulty, damaged, unsafe, not as described, or otherwise do not meet your legal rights as a consumer.
11. Returns and Refunds
Due to the perishable nature of our products, we do not accept returns of baked goods once dispatched, unless we specifically ask you to return something.
We do not offer change-of-mind refunds after dispatch for perishable food items.
However, if your order arrives damaged, incorrect, unfit for consumption, or not as described, please contact us as soon as possible after delivery with your order number and, where possible, clear photographs of the issue.
Where appropriate, we may offer a replacement, full refund, partial refund, or another suitable remedy.
Any refund approved by us will normally be made back to the original payment method.
12. Faulty, Damaged or Incorrect Items
If there is a problem with your order, you should contact us promptly after delivery.
Please include:
- your name
- order number
- delivery address
- a description of the issue
- photographs where appropriate
We may ask for further information in order to investigate and resolve the problem fairly.
13. Product Descriptions and Images
We make reasonable efforts to ensure that product descriptions, images, pricing and other content on the website are accurate.
However, images are for general illustration only. Because our products are handmade, the final product may vary slightly from the photographs shown.
We reserve the right to update, amend or remove product descriptions, pricing, product availability and website content at any time.
14. Our Rights in the Website
All content on this website, including text, branding, logos, graphics, images and design, belongs to Terry Bakes or is used with permission.
You may not copy, reproduce, distribute or use any content from this website for commercial purposes without our prior written permission.
15. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
This includes liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- supplying goods that are not as described
- supplying faulty goods
- any other rights you have under consumer law that cannot lawfully be excluded
Subject to the above, we shall not be liable for losses that were not foreseeable or for losses caused by events outside our reasonable control.
16. Events Outside Our Control
We will not be responsible for delays or failures caused by events outside our reasonable control, including but not limited to severe weather, transport disruption, courier failures, strikes, power outages, internet failures, supply shortages or other operational interruptions.
Where such issues arise, we will act reasonably and try to minimise the impact on your order.

Your use of this website is also subject to our Privacy Policy and Cookie Policy, which explain how we collect, use and protect your personal information.

We may update these Terms & Conditions from time to time.
